Terms & Condition

1. The Austrian Tourist Office, Inc. offers you a chance to win a china set from Wiener Porzellanmanufaktur Augarten. One Grand Prize: original Augarten set from the collection young@heart including one plate, one cup with saucer, one egg cup and one cereal bowl. The total value does not exceed US$2000 including delivery. 

Prize is non-transferable and no substitutions of this prize will be permitted.  Prize is not redeemable for cash or credit. Payment of taxes is the sole responsibility of the winner.  Employees, officers and representatives and their immediate families of the Austrian Tourist Office, Wiener Porzellanmanufaktur Augarten, and its subsidiaries are not eligible to enter. If the prize, or any part of the prize, is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize, or any part of the prize, with a prize of approximate value and/or specification, subject to any written directions from a regulatory authority. The Promoter accepts no responsibility for any variation in the value of the prize between the date of publication and the date the prize is taken. The Entry Form forms part of the terms and conditions of entry and entry implies acceptance of all terms and conditions.

2. How to enter:  Competition begins at 9.00 a.m. New York time on September 24, 2010 and ends 5:00 p.m. New York time on December 19, 2010 (“Entry Period”).  Persons are eligible to win one china set by submitting the answers (see no. 3 for details) to the question listed on the Austrian Tourism website at http//:www.austria.info/art  or by sending a letter or postcard with the answer to Austrian Tourist Office INC. 120 West, 45th street, New York, NY 10036. All ballot categories must be completed. Entries must be entered online or via mail by no later than the Entry Period. The Austrian Tourist Office is not responsible for lost, late or misdirected entries. Limit of one (1) entry person. In the event it is discovered that you attempted to enter more than once (regardless of method of entry) all your entries will be void. Entrants must be legal residents of either the United States or Australia and 18 years or older to win. No responsibility will be accepted for entries which are lost, misdirected, corrupted, damaged, illegible, which fail to arrive by the closing date, which are affected in any way by the malfunction of e-mail programs or servers, which contain incomplete and incorrect entrant contact details or automatically generated entries. All entries will become the property of the Promoters. Wiener Porzellanmanufaktur Augarten and the Austrian National Tourist Office reserve the right to withdraw or change the conditions of the competition at any time.

3. Winner will be selected on or about 12/20/10. The prize will be judged by a panel appointed by the Promoters. Each entry will be judged on creative merit. Chance plays no part in the determination of the winner. The drawing will be held under the supervision of the Austrian Tourist Office whose decision is final and binding upon all entrants and no correspondence will be entered into. Odds of winning are determined by the total number of entries received. The winner will be notified on or about 12/20/10 by email. By entering the competition you agree to be contacted by the Austrian Tourist Office by the specified method if you are selected as the winner. If the winner cannot be reached within 24-hours of the drawing, then an alternate entry will be drawn and the original winning entry will be void. The prize winner will be determined on 12/20/10 at Austrian Tourist Office NYC registered office. The winner’s name will be published on www.austria.info/art around 12/20/10. The price is expected to be delivered to the winners by mail about 8 weeks after confirmation. In the event of a dispute regarding submission of an online entry, the entry will be deemed submitted by the holder of the e-mail account. By accepting the prize, the prize winner agrees to sign a declaration and release form confirming compliance with the contest rules and regulations and releasing the Competition Sponsor of all liability that could result from the awarding or use of the prize.

4. By entering or accepting the prize, the winner consent to the use of their names and likenesses and/or biographical information for advertising and promotional purposes, as well as the publication of their names in response to winner inquiries, if any, without additional consideration from the Austrian Tourist Office.

5. By accepting the prize participants agree to be bound by the above rules. No purchase necessary. Void where prohibited by law.  All federal state and local laws and regulations apply. Terms and Conditions are subject to the official law of United States of America and Australia.

6. If for any reason the competition cannot be started or completed as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the competition, the Austrian Tourist Office, in its sole discretion, may disqualify any individual who tampers with the entry process by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs), and take any other steps it deems appropriate, including cancellation, termination, modification or suspension of the competition. The Austrian Tourist Office assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Furthermore, the Austrian Tourist Office assumes no responsibility for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Austrian Tourist Office on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the competition.

7. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. The Promoters and their associated agencies shall not be liable in any way if the performance of their obligations hereunder is delayed or becomes impossible by reason of any Act of God, war, fire, earthquake, strike, sickness, accident, civil commotion or any other cause.
